Business Name: Immensity of the Sea Pty Ltd
By accessing or using our services, you agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, please do not use the Platform.
Who we are
Immensity of the Sea Pty Ltd (“we”, “us”, “our”) provides digital tools to help SMBs streamline operations, systemise workflows, and gain visibility across service delivery. Our Platform includes Momentum Manager, SMB Health Check, and Website Glue, available via web and mobile interfaces.
Eligability
You must be at least 18 years old and have the authority to bind a business entity to these Terms. Our services are primarily intended for small and medium business owners and founders based in Australia.
User Accounts
To access certain features, you may need to create an account. You agree to provide accurate and complete information and to keep this information updated. You are responsible for maintaining the confidentiality of your account credentials.
Account Acceptance; Linked Legal Documents
By creating an account (including for Momentum Mapper and Business Health Check), you agree to our Terms of Use, Privacy Policy, and Consulting Services Agreement (where applicable). If access to Momentum Mapper or Business Health Check is provided as part of a consulting engagement, the Consulting Services Agreement prevails for those services. If access is provided standalone (free or subscription), these Terms of Use and the Privacy Policy apply.
Subscription & Payment
Our Platform operates on a subscription model with various tiers. By subscribing, you authorise us (or our third-party payment processor) to charge applicable fees to your nominated payment method. Prices are listed in Australian dollars unless otherwise stated.
Payments & Platforms
We may sell directly or facilitate purchases via third-party platforms such as Framer Marketplace or Glide. Payments may be processed by Stripe, Lemon Squeezy, or other providers. We do not store your payment card details. Purchases made via third-party platforms are also subject to those providers’ terms and policies.
Business Tools & Third-Party Terms
Some business tools we provide or configure rely on third-party software. Your use of those tools is also subject to the applicable third-party terms (for example, Glide, Airtable, or others).
Intellectual property
All content, branding, and software associated with our Platform is owned by or licensed to Immensity of the Sea Pty Ltd. You retain ownership of any content or data you upload, but grant us a limited licence to store, display, and use that data as necessary to provide our services.
Acceptable use
You agree not to:
Use the Platform for unlawful, harmful, or abusive purposes;
Reverse-engineer, scrape, or exploit the Platform;
Upload or transmit viruses or harmful code;
Use the Platform to collect or store sensitive data in breach of privacy laws.
We reserve the right to suspend or terminate access if you breach these Terms.
Service availability
We strive for high availability but do not guarantee uninterrupted access. Glide, our underlying platform, complies with SOC II TYPE 2, GDPR, and CCPA standards.
We may temporarily suspend access for maintenance or upgrades.
Third-party services
We use services like Glide, Stripe, and others. Your use of these services may be subject to their separate terms and privacy policies.
Affiliate Links
We may include affiliate links in our content. If you purchase through these links, we may earn a commission. These relationships do not influence our recommendations - we only suggest tools and services we believe are suitable for users.
Support
Support is provided via email and scheduled sessions during standard Australian business hours. We do not guarantee resolution times but aim to respond promptly.
Refunds and cancellation
We may offer a free trial where applicable. Subscriptions can be cancelled at any time via your account settings. Refunds are provided at our discretion in line with Australian Consumer Law.
Refunds — Digital Goods (Framer Components)
When purchasing components through the Framer Marketplace or directly from us, you are buying a digital product. Refunds are only provided if the component does not function as described or is unusable.
Requests must be made within 14 days of purchase by emailing support@immensityofthesea.com.
Refunds are not offered for change of mind or if you have already downloaded and used the component.
Consumer Rights
Nothing in this section affects your rights under Australian Consumer Law.
License & usage of digital goods
Licence Grant — Framer Components, Templates and Plugins
You are granted a non-exclusive, non-transferable licence to use in your own Framer projects.
Permitted Uses

Disclaimers and limited liability
Our services are provided “as is.” To the extent permitted by law, we disclaim all warranties. We are not liable for indirect, incidental, or consequential damages. Our total liability is limited to the amount you paid in the past 12 months.
Indemnity
You agree to indemnify, defend, and hold harmless Immensity of the Sea Pty Ltd, its directors, employees, and affiliates from any claims, liabilities, damages, losses, and expenses, including legal fees, arising out of or in any way connected with your access to or use of the Platform, your violation of these Terms, or your infringement of any third-party rights.
Changes to these terms
We may update these Terms at any time. Material changes will be notified via email or platform notice. Continued use after changes indicates acceptance.
Governing law
These Terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts in that region.

Some tools within the Platform are powered by artificial intelligence or machine learning to enhance user experience and productivity. These may include automated content generation, summaries, recommendations, or workflow suggestions.
By using these features, you acknowledge and agree that:
AI-generated outputs are for informational use only and may contain inaccuracies or omissions
You remain solely responsible for reviewing, validating, and relying upon such outputs
These tools are not a substitute for professional advice or human oversight
We disclaim all liability for outcomes based on AI-generated content. You agree not to use the Platform for high-risk or regulated decision-making where AI limitations may have material consequences.
Consulting Services
Consulting services and project work are governed by our Consulting Services Agreement. If you purchase consulting services, the Consulting Services Agreement applies in addition to these Terms. Where there is any inconsistency, the Consulting Services Agreement prevails for consulting services.
